The changes to the law regarding Education, Health and Care Plans have been extended to 30th June
The temporary changes brought in from 1st May for one month have been extended until 30th June. The Department for Education will keep this under review and there may be a further extension if necessary.
The changes remain the same as in May i.e. they offer greater flexibility to local authorities, commissioning health bodies and other bodies who contribute to the EHC process in responding to the demands placed on them by COVID-19.
Some aspects of EHC needs assessments are plans are unchanged; a local authority must still:
- Consider requests for a new EHC needs assessment
- Secure all of the required advice and information in order to be able to issue a plan
- Have regard to the views and wishes of a child, the child’s parent or a young person when carrying out its SEND functions.
